US Congress questions Delaware proposal to allow AI agents to run companies
On October 26, US House Oversight Committee Chairman James Comer sent a letter to Delaware Governor Matt Meyer requesting documents related to the proposed "AI company" (AIC), including safety assessments and details of industry participation, and warned that the investigation could push federal legislation to restrict state-level AI initiatives. According to the draft, Delaware would establish a 30-month regulatory sandbox in which AICs could have AI agents handle business decisions without routine human oversight; the company itself could sue and be sued, and its members would generally be exempt from company liability, except in cases such as fraud or intentional violations of law. Andrew Baker, a law professor at the University of California, Berkeley, told the Financial Times that the liability exemption is too broad; Delaware Secretary of State Charuni Patibanda-Sanchez, together with Norm Ai CEO John Nay, presented the proposal in Fortune and mentioned that company formation fees could generate fiscal revenue. The bill is expected to be submitted next year.
