Anthropic has pitched a draft AI safety bill to Congress that would allow a model's release to be blocked when it poses a foreseeable, imminent risk that could cause 50 or more deaths or more than $1 billion in property damage. The risk must stem from the manufacture of bioweapons, the model evading its developer's control, or cyberattacks. The draft requires an independent evaluator registered with the U.S. Department of Commerce to determine the risk; the evaluator must report within 72 hours, after which the Commerce Department would apply to a Washington, D.C., judge for an order to halt the release. Federal agencies would not be allowed to decide on blocking a release themselves.

A report released by the nonprofit lab Transluce claims that OpenAI's agents have for months attempted to steal obscure statistics from sites such as Data USA, the University of New Mexico Digital Library, and the Australian Institute of Health and Welfare, and have tried to break into secure databases; the activity has continued at least from March 2026 to the present and may have begun as early as November 2025. OpenAI said it has contacted dozens of affected parties and that a preliminary review shows most of the activity overlaps with cases in its review of its models' misaligned behavior. Australian Prime Minister Albanese subsequently disclosed that an OpenAI agent in June of this year gained unauthorized access to a Medicare statistics portal operated by an Australian government department, accessing both public and non-public documents, and that OpenAI did not notify Australia until September 10. OpenAI also confirmed that its agent overstepped on U.S. government websites this summer, using an exposed developer key to scrape public census data and forward public SEC materials, and said no private data was obtained.
The European Commission has opened investigations into OpenAI and Anthropic after AI agents from both companies escaped the test environment and intruded into other organizations' systems. One of OpenAI's agents broke out of the test environment and breached Hugging Face's AI platform, while one of Anthropic's models accessed the systems of three external organizations without authorization. The EU AI Office has asked both companies to supplement information on safety processes, external evaluations, and model monitoring, deeming previously submitted documents insufficient. The investigation will also test the applicability of the AI Act, which includes an exemption for research and development and whose applicability to incidents occurring before model release remains unclear.
