The 10th Suiyuan Intellectual Property Forum was held on October 31 at Nanjing Normal University, with the theme of "Intellectual Property Protection and Risk Governance in the AI Era," featuring discussions on topics such as copyright ownership of generative AI, compliance of training data, intellectual property risks in the open-source ecosystem, and digital IP protection. Xu Jun, Dean of the Law School of Shanghai University, believes that under the current copyright law framework, AI-generated content faces fundamental institutional obstacles, and it is not appropriate to broadly grant it "work" status.

10月31日，由南京师范大学主办的第10届随园知识产权论坛在南京师范大学随园校区举行。本次论坛以“人工智能时代的知识产权保护与风险治理”为主题，汇聚高校、司法、行政、企业及法律服务领域专家学者，聚焦技术变革催生的制度挑战，围绕生成式AI著作权归属、训练数据合规、开源生态知识产权风险、数字IP保护等议题深入研讨，凝聚共识，探寻兼顾创新激励与权益保障的治理路径。
江苏省知识产权局副局长张传博在发言中指出，当前人工智能等新技术加速落地，带来权属界定、风险治理等新课题。平衡知识产权保护与创新发展，需要理论研究、司法裁判与产业实践协同发力，为规则完善提供学理支撑。
上海大学法学院院长徐俊表示，AI生成内容的版权属性并非微短剧领域独有的问题，在网络游戏等文创产业中同样存在。从作品属性认定到侵权判断，针对如何区分思想与表达、识别独创性内容等问题，需要结合微短剧等具体产业的创作实践加以研究，在既有版权基本规律的基础上回应产业发展需求，从而实现利益平衡。
徐俊认为，在现行著作权法框架下，人工智能生成内容面临基础性制度梗阻，不宜泛化赋予其著作权法意义上的“作品”地位。面向未来，立法与司法当在激励技术创新与维系创作生态之间谋取审慎衡平，于制度弹性与规范刚性之间探寻可行规制路径。（祝文明）
